Terms of Use

These Terms of Use ("Terms") are an agreement between you and Game Plan AI LLC, a Florida limited liability company ("Game Plan," "we," "us"). They cover The Gameplan mobile app, its Apple Watch app, Siri shortcuts and share extension (the "App"), the website gameplanai.app (the "Site") and related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

1. Who can use the Service

You must be at least 13 years old to create an account. If you're under 18, or under the age of majority where you live, you may use the Service only with the involvement and consent of a parent or guardian, who agrees to these Terms for you. Only an adult can buy a subscription. A parent or guardian may add children to a family group as members without their own accounts, and is responsible for that use.

2. Your account

Give us accurate information and keep your password secure. You're responsible for activity under your account. Tell us right away at michael@gameplanai.app if you think someone has accessed it without permission. You can delete your account at any time in the App's settings.

3. Family groups

You can invite people to a family group and share plans, events and tasks with them. Everyone in a group can see what is shared there. Group admins can manage members. If you leave a group or delete your account, the plans you shared with the group may remain with the group. Only invite people you trust, and only add other people's information if you have the right to.

4. Subscriptions and payments

• Plans. Some features require a paid Game Plan Pro subscription. One subscription covers your family group. Prices and billing periods are shown before you buy and may vary by country.
• Auto-renewal. Subscriptions renew automatically at the end of each billing period at the then-current price unless you cancel at least 24 hours before the period ends. Your payment method is charged within 24 hours before renewal.
• Free trials. If you start a free trial, you'll be charged when it ends unless you cancel before then. Trial terms are shown when you sign up.
• App Store purchases. If you subscribe in the App through Apple, Apple processes the payment and Apple's terms apply. Manage or cancel in your Apple ID's Subscriptions settings. Refunds for Apple purchases are handled only by Apple.
• Web purchases. If you subscribe through our web checkout, payment is processed by our providers (RevenueCat and Stripe). Manage or cancel through the billing link in your receipt or in the App. Except where the law requires otherwise, payments are non-refundable and there are no refunds or credits for partial periods.
• Cancelling. When you cancel, you keep access until the end of the period you've paid for. Deleting your account does not cancel your subscription.
• Price changes. We'll give you advance notice of any price change, as required by Apple or the law, and you can cancel before it takes effect.

5. Your content

"Your content" means everything you put into the Service, such as tasks, events, notes, voice notes, photos, forwarded emails and messages. You own your content. You give Game Plan a limited, worldwide, non-exclusive, royalty-free license to host, store, process, transmit and display your content only as needed to provide, maintain and improve the Service for you, including sending it to our service providers such as OpenAI as described in our Privacy Policy. This license ends when you delete the content or your account, except for content you've shared with others and backups kept for a limited time.

You confirm you have the rights to the content you add, including other people's names, photos and contact details.

6. AI features

The Service uses artificial intelligence to understand requests, create tasks and events, summarize content and suggest plans. AI output can be inaccurate, incomplete or out of date.

AI features are optional. The App asks for your permission before it first sends anything to our AI provider (OpenAI), and you can turn AI features off at any time in Settings → Use AI. The rest of the Service, including calendar sync and adding plans yourself, keeps working without them. Our Privacy Policy explains what is sent.

• Review suggestions before relying on them, especially times, locations, deadlines and instructions.
• The Service does not give medical, health, fitness, financial, legal or other professional advice. Readiness scores and workout suggestions are general information only. Talk to a qualified professional before making health or training decisions.
• You're responsible for the decisions you make and the actions you take based on the Service.

7. Driving and safety

Travel times and errand-run suggestions are estimates and may not reflect traffic, road conditions or closures. Don't use the App in a way that distracts you while driving. Obey traffic laws and use your own judgment about routes and safety. Carpool features help families coordinate; we don't check drivers, vehicles or rides, and you're responsible for those arrangements.

8. Text message program

If you link a phone number, you agree to receive text messages from The Gameplan, including verification codes and replies to messages you send. Message frequency varies. Message and data rates may apply. Reply STOP to cancel at any time, START to resume, or HELP for help, or email michael@gameplanai.app. Carriers are not liable for delayed or undelivered messages.

9. Connected services

The Service works with third-party services you choose to connect, such as Google Calendar, Microsoft Outlook, Apple Health, Health Connect, WHOOP and calendar feeds. Your use of those services is governed by their own terms. We aren't responsible for them, their availability or the accuracy of the data they provide.

10. Acceptable use

You agree not to:

• Break the law or infringe anyone's rights, including privacy and intellectual property rights.
• Upload content that is illegal, harmful, harassing, hateful or sexually explicit, or that exploits children.
• Add or track another person without their permission, or use the Service to stalk or harass anyone.
• Send spam through email forwarding, text messages or shared links.
• Interfere with the Service, probe or breach its security, bypass rate limits or access controls, or reverse engineer it except where the law allows.
• Scrape the Service or use automated means to access it, or use it to build a competing product or train AI models.
• Resell, sublicense or share your account outside your family group.

We may suspend or end your access if you violate these Terms or if we need to protect the Service, other users or the public.

11. Our property

The Service, including its software, design, field maps and branding, belongs to Game Plan and its licensors and is protected by law. We give you a personal, non-transferable, revocable license to use the App on Apple devices you own or control, as permitted by these Terms and Apple's Usage Rules. If you send us feedback or ideas, we may use them without obligation to you.

12. Changes to the Service

We may add, change or remove features, and we may stop offering the Service. If we discontinue a paid service, we'll give you reasonable notice. Beta or preview features are provided as they are and may change or stop at any time.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, GAME PLAN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DON'T PROMISE THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, THAT REMINDERS OR NOTIFICATIONS WILL ALWAYS ARRIVE ON TIME, OR THAT AI OUTPUT, TRAVEL TIMES OR SYNCED DATA WILL BE ACCURATE.

14. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, GAME PLAN AND ITS MEMBERS, EMPLOYEES AND PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OPPORTUNITIES OR MISSED APPOINTMENTS, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US $50. Some places don't allow these limits, so they may not fully apply to you.

15. Indemnity

You agree to defend and hold harmless Game Plan from claims, losses and expenses (including reasonable attorneys' fees) arising from your content, your misuse of the Service or your violation of these Terms or anyone's rights.

16. Ending these Terms

You can stop using the Service and delete your account at any time. We may suspend or end your access as described above. Sections that by their nature should survive, such as payment obligations, content licenses for shared content, disclaimers, limitation of liability, indemnity and governing law, survive termination.

17. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Before filing a claim, please contact us so we can try to resolve it informally. Any dispute that isn't resolved informally will be brought only in the state or federal courts located in Duval County, Florida, and you and Game Plan consent to their jurisdiction. Either party may bring a qualifying claim in small claims court. Nothing here limits rights you have under consumer protection laws that can't be waived.

18. Apple terms

If you downloaded the App from the Apple App Store:

• These Terms are between you and Game Plan only, not Apple. Game Plan, not Apple, is responsible for the App and its content.
• Apple has no obligation to provide maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the extent permitted by law, Apple has no other warranty obligation regarding the App.
• Game Plan, not Apple, is responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
• If a third party claims the App infringes its intellectual property, Game Plan, not Apple, is responsible for investigating, defending, settling and discharging the claim.
• You confirm you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and you are not on any U.S. Government list of prohibited or restricted parties.
• You must comply with any applicable third-party terms when using the App.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

19. General

We may update these Terms. If a change is material, we'll tell you in the App or by email before it takes effect, and continuing to use the Service after that means you accept the new Terms. These Terms and our Privacy Policy are the entire agreement between you and Game Plan about the Service. If any part is found unenforceable, the rest stays in effect. Our not enforcing a provision isn't a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets.
